A company protested the scope of a Determination and Finding by the Secretary of Defense that a product largely fabricated in the United Kingdom was excepted from application of the Buy American Act. Because of the product's exception from the act, the procuring activity improperly evaluated the protester's price as being other than the lowest price. The protest was sustained.

  • Interoperability Clearinghouse
We dismiss the protest because the protester, a not-for-profit entity, is not an interested party to challenge this sole-source award to an Alaska Native Corporation under the Small Business Administration's (SBA) 8(a) program.
