This is in further response to a request for a waiver of the debt owed the United States for excess and erroneous payments on a military pay account. Collections from the member's pay was applied to the debt total of $657.75. However, pursuant to the member's request for waiver, the Claims Division waived $381.13 of the debt comprised of a June 1968 duplicate payment and a June 1968 overpayment. After review, it was determined that his debt for $413.71 should also be waived. With regard to a casual payment of $635, it appears that it was proper when made and, therefore, no erroneous payment having been made, is not for consideration for waiver under 10 U.S.C. 2774, supra.
