A company contended that it should have been given priority in accordance with an applicable regulation in a contract awarded under a negotiated procurement in which there were two equally priced offerers. The regulation was incorrectly applied, and the award was improper. No corrective action can be taken on this procurement since contract performance has been completed, but action is being taken to prevent such errors in future procurements.
