A former Army member appealed a determination denying his request for waiver of the claim of the United States against him for erroneous payments made incident to his discharge from military service. The erroneous payment which resulted from the failure of the Army to deduct a mid-month payment already paid the member from the member's final payment upon discharge was waived in view of the short notice the member received of his early discharge and of the serious family problem which occurred at the time of the discharge. However, the erroneous payment which resulted from an end-of-month check mailed to the member subsequent to his discharge and after he had received both mid-month and final payments on discharge was not waived since the member should have inquired as to the correctness of such payments.
