An advance decision was requested regarding the claim of a retired Army member for refund of deductions from his retired pay made for the Survivor Benefit Plan. Members who retired before the Survivor Benefit Plan effective date and who elected to participate in the Plan may not unilaterally revoke such elections. Revocation or correction of a Survivor Benefit Plan election based upon "administrative error" is a secretarial prerogative and may be exercised to revoke or modify Survivor Benefit Plan coverage based upon a finding that the member received erroneous or insufficient information.
