The Langer Transportation Company asked for GAO's opinion regarding unpaid freight bills for services provided to the government by the company, contending that the running of the time limitation in 49 U.S.C. 66 had been tolled because the Vietnam conflict was in "any time of war."

GAO determined that the phrase "any time of war" would begin with the Congress of the United States exercised its power to declare war, and that GAO's Transportation and Claims Division should consider the three-year statute of limitations to be applicable in connection with its consideration of those unpaid bills.
