PRECIS-UNAVAILABLE TO SECRETARY OF THE NAVY: ENCLOSED IS A COPY OF OUR DECISION OF TODAY REGARDING THE PROTEST OF TELEDYNE INET AGAINST ELIMINATION OF ITS PROPOSAL FROM THE COMPETITIVE RANGE BY THE NAVAL SHIP SYSTEMS COMMAND UNDER RFP N00024-73-R-7536(S). ALTHOUGH WE HAVE DENIED THE PROTEST. WHICH REQUIRES THAT OFFERORS WITH WHOM DISCUSSIONS ARE HELD BE ADVISED OF DEFICIENCIES IN THEIR PROPOSALS. WAS NOT STRICTLY FOLLOWED IN THIS CASE.

ALTHOUGH WE HAVE DENIED THE PROTEST, WE CALL YOUR ATTENTION TO THE FACT THAT ASPR 3-805.3(A), AS REVISED BY DPC #110, WHICH REQUIRES THAT OFFERORS WITH WHOM DISCUSSIONS ARE HELD BE ADVISED OF DEFICIENCIES IN THEIR PROPOSALS, WAS NOT STRICTLY FOLLOWED IN THIS CASE. WE SUGGEST THAT YOUR PROCUREMENT OFFICIALS BE REMINDED OF THE REQUIREMENTS OF ASPR 3-805.3(A) WITH A VIEW TOWARD PREVENTING THIS TYPE OF SITUATION IN THE FUTURE.
