WAS NOT IN VIOLATION OF THE "HIGHEST-PREVIOUS RATE" RULE. SINCE CLAIMANT WAS NOT AN EXCEPTION TO THE NAVY'S POLICY NOT TO USE A STEP ABOVE THE MINIMUM STEP REQUIRED BY LAW. THE CLAIM IS AGAIN DENIED.
