AULTMAN: REFERENCE IS MADE TO YOUR LETTER OF MARCH 9. SINCE YOU WERE NOT IN A TRAVEL STATUS DURING THE PERIODS INVOLVED WE MUST SUSTAIN THE DISALLOWANCE OF PER DIEM IN LIEU OF SUBSISTENCE. REFERENCE IS MADE TO YOUR LETTER OF MARCH 9, 1970, IN WHICH YOU IN EFFECT REQUEST REVIEW OF THE SETTLEMENT OF OUR CLAIMS DIVISION, DATED FEBRUARY 17, 1970, DENYING YOUR CLAIM FOR PER DIEM ALLOWANCES FOR YOU AND YOUR WIFE FROM JUNE 11 THROUGH JUNE 25, 1967, FROM AUGUST 23 THROUGH SEPTEMBER 22, 1967, AND FOR HOUSING ALLOWANCE FROM AUGUST 25 THROUGH OCTOBER 15, 1967, AS AN OVERSEAS SCHOOL TEACHER WITH THE DEPARTMENT OF THE AIR FORCE.

SINCE YOU WERE NOT IN A TRAVEL STATUS DURING THE PERIODS INVOLVED WE MUST SUSTAIN THE DISALLOWANCE OF PER DIEM IN LIEU OF SUBSISTENCE. ALTHOUGH THE SETTLEMENT CERTIFICATE OF FEBRUARY 17, 1970, IMPLIED THAT PER DIEM WAS DISALLOWED BECAUSE OF A DELAY IN TRAVEL FOR YOUR CONVENIENCE, THE DISALLOWANCE MUST STAND IRRESPECTIVE OF THE REASON FOR THE DELAY AS PER DIEM IN LIEU OF SUBSISTENCE IS PAYABLE ONLY FOR PERIODS DURING WHICH YOU WERE IN A TRAVEL STATUS. HOWEVER, WE HAVE NOW DETERMINED THAT YOU WERE ENTITLED TO A CONTINUATION OF THE LIVING QUARTERS ALLOWANCE APPLICABLE TO LIBYA COVERING THE PERIOD FROM AUGUST 26, 1967, TO OCTOBER 15, 1967, INCLUSIVE, A TOTAL OF 51 DAYS AT THE RATE OF $3.83 PER DAY. A SETTLEMENT IN YOUR FAVOR FOR $195.33 WILL ISSUE IN DUE COURSE.
