In 1954, the Societe Anonyms des Ateliere Brillie Freres deposited with the Government the sum of $15,000 which has been held in escrow by the Office of Alien Property, and on January 11, 1963, the Court of Claims ordered that the plaintiff recover that amount. The Department of Justice requested GAO's opinion as to whether the judgement may be paid directly from the escrow account by the Office of Alien Property, or if the money would have to be transferred and settlement made by this Office. GAO found that the present judgement was not intended for payment out of the general appropriation referred to since it provides for payment of a sum "otherwise provide for", i.e., a specific amount being held in an "escrow account" by the Alien Property Custodian. Accordingly, the protest was sustained.
