TO BIRMINGHAM BUSINESS COLLEGE: REFERENCE IS MADE TO YOUR LETTER OF JANUARY 11. ALLEGED TO BE DUE FOR TUITION AND TEXTBOOKS STATED TO HAVE BEEN FURNISHED VETERAN TRAINEES UNDER PUBLIC CONTRACTS WITH THE VETERANS ADMINISTRATION. CHARGES HAVE BEEN RAISED BY THE ADMINISTRATIVE OFFICE IN EXCESS OF THE APPROVED AMOUNTS OF THE UNPAID VOUCHERS. IN VIEW OF OTHER ASPECTS OF THE CASE SUCH ACTION IS BEING WITHHELD. THE MATTER IS BEING REFERRED TODAY TO THE DEPARTMENT OF JUSTICE FOR CONSIDERATION AND APPROPRIATE ACTION.

REFERENCE IS MADE TO YOUR LETTER OF JANUARY 11, 1956, RELATIVE TO YOUR CLAIM FOR APPROXIMATELY $13,500, ALLEGED TO BE DUE FOR TUITION AND TEXTBOOKS STATED TO HAVE BEEN FURNISHED VETERAN TRAINEES UNDER PUBLIC CONTRACTS WITH THE VETERANS ADMINISTRATION.

IN VIEW OF THE FACTS DISCLOSED BY AN AUDIT OF YOUR ACCOUNTS AND RECORDS, CHARGES HAVE BEEN RAISED BY THE ADMINISTRATIVE OFFICE IN EXCESS OF THE APPROVED AMOUNTS OF THE UNPAID VOUCHERS. THEREFORE, ON THE BASIS OF THE PRESENT RECORD ANY SETTLEMENT ACTION TAKEN WOULD RESULT IN A BALANCE DUE THE UNITED STATES. HOWEVER, IN VIEW OF OTHER ASPECTS OF THE CASE SUCH ACTION IS BEING WITHHELD, AND THE MATTER IS BEING REFERRED TODAY TO THE DEPARTMENT OF JUSTICE FOR CONSIDERATION AND APPROPRIATE ACTION.
