BY FIRST INDORSEMENT DATED SEPTEMBER 29, 1952, THE CHIEF OF FINANCE REFERRED TO THIS OFFICE YOUR LETTER OF SEPTEMBER 12, 1952, REQUESTING AN ADVANCE DECISION WHETHER YOU ARE AUTHORIZED TO MAKE PAYMENT ON A VOUCHER, TRANSMITTED THEREWITH, IN FAVOR OF MRS. LILLIAN HANSON, ADOPTIVE MOTHER OF LUTHER DICK HANSON, LATE PRIVATE, FIRST CLASS, UNITED STATES ARMY, FOR $897.30, REPRESENTED AS EQUAL TO THE PAY OF THE DECEDENT FOR SIX MONTHS, THE CLAIM ARISING UNDER THE ACT OF DECEMBER 17, 1919, AS AMENDED, 10 U.S.C. 903.

THE OFFICIAL REPORT OF DEATH SHOWS THAT THE DECEDENT DIED IN THE MILITARY SERVICE ON JULY 11, 1950, NOT THE RESULT OF HIS OWN MISCONDUCT, AND THAT HE DESIGNATED THE PAYEE OF THE SAID VOUCHER AS PRIMARY BENEFICIARY TO RECEIVE THE SIX MONTHS' DEATH GRATUITY. THE VOUCHER INDICATES THAT THE DECEDENT WAS NOT SURVIVED BY A WIDOW OR CHILD AND THERE WAS SUBMITTED WITH YOUR LETTER A CERTIFIED COPY OF A DECREE IN ADOPTION ISSUED MARCH 4, 1939, BY THE DISTRICT COURT, BLUE EARTH COUNTY, STATE OF MINNESOTA, EVIDENCING THE ADOPTION OF THE DECEDENT BY THE SAID PAYEE AND HER HUSBAND, J. H. HANSON.

SINCE IT APPEARS THAT THE DECEDENT AT THE DATE OF HIS DEATH WAS THE CHILD, BY ADOPTION, OF LILLIAN HANSON, THE LATTER PROPERLY IS TO BE CONSIDERED WITHIN THE CLASS OF RELATIVES ENTITLED TO RECEIVE THE SIX MONTHS' DEATH GRATUITY AND YOU ARE AUTHORIZED TO MAKE PAYMENT ON THE ABOVE -MENTIONED VOUCHER IF OTHERWISE PROPER.
