A firm protested a Department of Health and Human Services (HHS) contract award for health care services, contending that HHS did not award the contract in accordance with the solicitation provisions. GAO held that HHS fairly evaluated the tiebreaker factor since the solicitation did not specify a particular way in which to evaluate the factor. Accordingly, the protest was denied.
