WE ADVISED YOU THAT THE RECORD RELATIVE TO BILL OF LADING N 22274037 WAS BEING RETURNED TO OUR TRANSPORTATION DIVISION FOR ALLOWANCE OF THE SUM OF $31.43. WE HAVE BEEN ADVISED SUCH SETTLEMENT WAS EFFECTED ON FEBRUARY 14. AS TO THE BALANCE OF $50.56 IS MERELY A RESTATEMENT OF THE ARGUMENTS PREVIOUSLY RAISED BY YOU IN CONNECTION WITH THESE SHIPMENTS TRANSPORTED BY YOU UNDER THE PROVISONS OF SOUTHWESTERN MOTOR TARIFF BUREAU. THESE ARGUMENTS HAVE ALREADY BEEN CONSIDERED ON SEVERAL OCCASIONS AND REJECTED. WE HAVE EXAMINED THE DECISIONS OF THE COMPTROLLER GENERAL CITED IN YOUR LETTER OF JANUARY 10.

REFERENCE IS MADE TO YOUR LETTER OF JANUARY 10, 1963, FILE N-694/51 UC- 112, IN EFFECT REQUESTING FURTHER CONSIDERATION OF OUR DECISIONS OF FEBRUARY 19 AND NOVEMBER 21, 1962, B-146577, SUSTAINING THE DISALLOWANCE OF YOUR CLAIM FOR THE AMOUNTS OF $38.63 AND $11.93 IN ADDITION TO THE AMOUNTS PREVIOUSLY PAID FOR THE TRANSPORTATION FURNISHED ON BILLS OF LADING NOS. N-14224270 AND N-14204421, RESPECTIVELY, IN SEPTEMBER 1951.

WE NOTE THAT IN THE FINAL SENTENCE OF YOUR LETTER YOU ASK THAT WE REMIT $81.99. SUCH AMOUNT APPARENTLY IS COMPRISED OF $11.93, $38.63 AND $31.43 WHICH YOU CLAIMED ON THE TWO BILLS OF LADING CITED AND ON N 22274037. THE FINAL PARAGRAPH OF OUR DECISION OF FEBRUARY 19, 1962, WE ADVISED YOU THAT THE RECORD RELATIVE TO BILL OF LADING N 22274037 WAS BEING RETURNED TO OUR TRANSPORTATION DIVISION FOR ALLOWANCE OF THE SUM OF $31.43, IF OTHERWISE CORRECT. WE HAVE BEEN ADVISED SUCH SETTLEMENT WAS EFFECTED ON FEBRUARY 14, 1963, AND WE TRUST A CHECK IN PAYMENT OF SUCH AMOUNT NOW HAS BEEN RECEIVED.

YOUR REQUEST, AS TO THE BALANCE OF $50.56 IS MERELY A RESTATEMENT OF THE ARGUMENTS PREVIOUSLY RAISED BY YOU IN CONNECTION WITH THESE SHIPMENTS TRANSPORTED BY YOU UNDER THE PROVISONS OF SOUTHWESTERN MOTOR TARIFF BUREAU, U.S. GOVERNMENT QUOTATION NO. 1. THESE ARGUMENTS HAVE ALREADY BEEN CONSIDERED ON SEVERAL OCCASIONS AND REJECTED. SEE IN THIS CONNECTION OUR PRIOR DECISIONS CITED IN THE FIRST PARAGRAPH OF THIS LETTER AND B- 148053 OF MARCH 29, 1963, COPY ATTACHED.

ALSO, WE HAVE EXAMINED THE DECISIONS OF THE COMPTROLLER GENERAL CITED IN YOUR LETTER OF JANUARY 10, 1963, AND FIND NOTHING THEREIN WHICH IS INCONSISTENT WITH THE DISALLOWANCE OF YOUR SUPPLEMENTAL CLAIMS ON BILLS OF LADING N-14224270 AND N-14204421. ACCORDINGLY, OUR PREVIOUS DECISIONS AS TO THESE BILLS OF LADING ARE AFFIRMED.
