BACKGROUND The Federal Retirement Thrift Investment Board was established under the provisions of the Federal Employees' Retirement System Act of 1986. The primary purpose of the Board is to administer the Thrift Savings Plan provisions of the Act. 5 U.S.C. Compensation for each member of the Board who is not an officer or employee of the federal government is set at the daily rate of basic pay for grade GS-18 of the General Schedule for each day the member is engaged in performing a function of the Board. 5 U.S.C. We have long held in similar circumstances that those members who are not regular officers or employees of the federal government are entitled to the entire amount of their daily rate regardless of the number of hours they work when they are performing Board -related duties. 45 Comp.Gen. 131 (1965).

CIVILIAN PERSONNEL - Compensation - Board Members DIGEST: Federal Retirement Thrift Investment Board members may be paid for a full day while on Board business regardless of the hours worked since the enabling statute does not provide for any other terms of reimbursement except for the daily rate of basic pay for grade GS-18 of the General Schedule.

Federal Retirement Thrift Investment Board - Compensation of Members:

The Executive Director, Federal Retirement Thrift Investment Board, requests a decision on the issue of whether Thrift Board members may be paid for a full day while on Board business regardless of the hours worked. We conclude that the members may be reimbursed for the whole day since the enabling statute specifically provides for pay on a daily basis.

BACKGROUND

The Federal Retirement Thrift Investment Board was established under the provisions of the Federal Employees' Retirement System Act of 1986, Pub. L. No. 99-335, 100 Stat. 517 (1986), 5 U.S.C. Secs. 8401-8479 (Supp. IV 1986). The primary purpose of the Board is to administer the Thrift Savings Plan provisions of the Act. 5 U.S.C. Sec. 8472(f).

Compensation for each member of the Board who is not an officer or employee of the federal government is set at the daily rate of basic pay for grade GS-18 of the General Schedule for each day the member is engaged in performing a function of the Board. 5 U.S.C. Sec. 8476(d)(1).

0PINION The statutory language cited above does not provide for any other terms of reimbursement than a daily rate of basic pay for grade GS-18 of the General Schedule. We have long held in similar circumstances that those members who are not regular officers or employees of the federal government are entitled to the entire amount of their daily rate regardless of the number of hours they work when they are performing Board -related duties. 45 Comp.Gen. 131 (1965); 28 Comp.Gen. 211 (1948); Wiretap Commission, B-182851, Feb. 11, 1975.

The members may be reimbursed accordingly.
