WE HAVE YOUR LETTER OF JULY 5, 1967, ADVISING THAT YOUR CLIENT, THE DON MCADEN COMPANY, AUTHORIZED YOU TO SUBMIT AN OFFER IN SETTLEMENT OF THE GOVERNMENT'S CLAIM FOR $7,642.80, THE VALUE OF TWO TRUCKLOADS OF LETTUCE REJECTED IN MAY 1965 BECAUSE OF ITS DETERIORATION IN TRANSIT. THE OFFER PROPOSES PAYMENT OF 50 PERCENT OF THE AMOUNT DUE, OR $3,821.40, WHICH INCLUDES $1,678.27 ADMITTEDLY DUE THE GOVERNMENT BUT WITHHELD BY THE CARRIER PENDING FINAL SETTLEMENT.

WE HAVE DETERMINED THAT ACCEPTANCE OF THIS OFFER IS JUSTIFIED IN THE CIRCUMSTANCES OF THE CASE. COMPROMISE SETTLEMENT OF THE GOVERNMENT'S CLAIM OBVIATES THE COST OF FURTHER HANDLING BY BOTH PARTIES AND POSSIBLE LITIGATIVE COSTS, THE CARRIER'S CHECK FOR $3,821.40 SHOULD BE MADE PAYABLE TO THE "U.
