WE HAVE RECEIVED FROM THE FINANCE CENTER, U.S. ARMY, INDIANAPOLIS, INDIANA, YOUR LETTER DATED AUGUST 14, 1959, CONCERNING YOUR CLAIM FOR THE AMOUNT OF $100 WHICH YOU BELIEVE IS DUE YOU AS MUSTERING-OUT PAY INCIDENT TO YOUR DISCHARGE FROM THE ARMY ON JANUARY 14, 1943.

YOU STATE THAT YOUR DISCHARGE CERTIFICATE ORIGINALLY SHOWED 58 DAYS' SERVICE BUT THAT IT HAS BEEN CORRECTED TO SHOW 2 MONTHS AND 11 DAYS AND THAT, CONSEQUENTLY, YOU ARE ENTITLED TO MUSTERING-OUT PAY IN THE AMOUNT OF $100 IN ADDITION TO THE AMOUNT OF $100 WHICH YOU HAVE ALREADY RECEIVED. YOU ALSO STATE THAT YOU RECEIVED PAY FROM THE TIME YOU TOOK THE OATH.

THE RECORDS SHOW THAT YOU WERE INDUCTED INTO THE MILITARY SERVICE ON NOVEMBER 4, 1942, AND TRANSFERRED TO THE ENLISTED RESERVE CORPS ON THE SAME DATE; THAT YOU REPORTED FOR ACTIVE DUTY ON NOVEMBER 18, 1942; AND THAT YOU WERE HONORABLY DISCHARGED ON JANUARY 14, 1943. THUS, YOU HAD ACTIVE SERVICE ONLY FROM NOVEMBER 18, 1942, TO JANUARY 14, 1943, A TOTAL OF 58 DAYS. SINCE MUSTERING-OUT PAYMENTS UNDER THE APPLICABLE PROVISIONS OF THE MUSTERING-OUT PAYMENT ACT OF 1944, 58 STAT. 8, WERE BASED ON ACTIVE SERVICE ONLY, YOU WERE ADVISED, THAT YOU WERE ENTITLED TO MUSTERING-OUT PAY IN THE AMOUNT OF ONLY $100, WHICH IS THE AMOUNT PROVIDED IN THAT ACT FOR PERSONS WHO PERFORMED ACTIVE SERVICE FOR LESS THAN 60 DAYS.

IN VIEW OF YOUR STATEMENT AS TO THE DAY YOU COMMENCED TO RECEIVE PAY, THE VOUCHERS COVERING THE PAYMENTS MADE TO YOU FOR THE PERIOD INVOLVED HAVE BEEN EXAMINED. THE FIRST PAYMENT MADE TO YOU FOR THAT PERIOD WAS IN THE AMOUNT OF $13.37 AND SUCH PAYMENT WAS MADE ON VOUCHER NO. 11365, DECEMBER 1942 ACCOUNTS OF COLONEL J. L. YUNSTALL. THE AMOUNT OF $13.37 SO PAID REPRESENTED THE PAY OF A PRIVATE AT THE RATE OF $50 A MONTH FOR THE 13-DAY PERIOD FROM NOVEMBER 18 TO 30, 1942, OR $21.67, LESS A DEDUCTION OF $8.30 TO COVER YOUR CLASS N ALLOTMENT FOR NATIONAL SERVICE LIFE INSURANCE. COPIES OF THE PERTINENT PARTS OF VOUCHER NO. 11365 ARE ENCLOSED. RECORD HAS BEEN FOUND SHOWING THAT YOU RECEIVED ANY PAY FOR THE PERIOD FROM NOVEMBER 4 TO 17, 1942, OR THAT THERE IS ANY REASON FOR CONSIDERING THAT PERIOD AS A PERIOD OF ACTIVE SERVICE.

IT APPEARS THAT YOU HAVE BEEN PAID THE FULL AMOUNT PROVIDED BY LAW AS MUSTERING-OUT PAY.
