REFERENCE IS MADE TO YOUR LETTER OF MARCH 5, 1964, FORWARDING FOR OUR CONSIDERATION THE CLAIM OF AMERICAN NICKEL ALLOY MANUFACTURING CORPORATION FOR ADJUSTMENT OF THE PRICE PAID FOR 1,500 POUNDS OF SCRAP INCONEL PURCHASED UNDER SALES INVITATION NO. 11-S-64-22, ISSUED BY THE DEFENSE SURPLUS SALES OFFICE, PHILADELPHIA NAVAL BASE, PHILADELPHIA, PENNSYLVANIA.

ENCLOSED IS A COPY OF OUR LETTER OF TODAY TO THE PURCHASER IN WHICH WE PROPOSE ALTERNATE PLANS TO DISPOSE OF THE MATTER BY ACCEPTANCE OF PAYMENT IN THE REDUCED AMOUNT OF $114.57, OR BY ACCEPTANCE OF $75.37 FOR THE 150- POUND QUANTITY VARIATION PERMISSIBLE UNDER THE SALES CONTRACT AND BY RETURN TO THE GOVERNMENT OF THE EXCESS 784 POUNDS OF MATERIAL. ACTION TO COLLECT THE AMOUNT OF $469.43 BASED ON THE CONTRACT RATE OF $0.50261 PER POUND FOR THE 934-POUND OVERAGE DELIVERED TO THE PURCHASER SHOULD BE WITHHELD PENDING FURTHER ADVICE FROM OUR OFFICE.
