CLINT SLUSHER: REFERENCE IS MADE TO YOUR LETTER OF AUGUST 31. 000 CHECK WHICH YOU ALLEGED WAS ISSUED TO YOUR GRANDMOTHER. SINCE SUCH LETTER AND YOUR PREVIOUS LETTERS CONTAIN NO CLEAR OR SATISFACTORY EVIDENCE THAT THERE IS OR EVER WAS ANY LIABILITY OF THE GOVERNMENT SUCH AS YOU ALLEGE. OR ANY INFORMATION THAT A CHECK IN THAT AMOUNT WAS ISSUED TO HER. IN THE ABSENCE OF CLEAR AND SATISFACTORY EVIDENCE OF THE VALIDITY AND NONPAYMENT OF A CLAIM THE ACCOUNTING OFFICERS OF THE GOVERNMENT ARE AUTHORIZED AND IT IS THEIR DUTY TO REJECT IT. AS TO THE STATEMENT IN YOUR LATEST LETTER THAT "IF THE CHECK WAS RETURNED * * * IT WOULD HAVE BEEN RETURNED TO WASHINGTON. " YOU ARE ADVISED THAT SUCH STATEMENT APPEARS TO BE BASED UPON THE MERE SUPPOSITION THAT SUCH A CHECK WAS ISSUED.

B-80840, OCT. 18, 1955

TO MR. CLINT SLUSHER:

REFERENCE IS MADE TO YOUR LETTER OF AUGUST 31, 1955, IN FURTHER REGARD TO YOUR CLAIM FOR $1,000 CHECK WHICH YOU ALLEGED WAS ISSUED TO YOUR GRANDMOTHER, MRS. PATSY SLUSHER, NEAR THE CLOSE OF THE CIVIL WAR, ON ACCOUNT OF SERVICE OF HER SONS AS VOLUNTEERS IN THE ARMY OF THE UNITED STATES DURING THE CIVIL WAR.

AS SET FORTH IN OUR LETTER OF JULY 28, 1955, THIS MATTER HAS BEEN CAREFULLY CONSIDERED UPON NUMEROUS OCCASIONS. YOUR LATEST LETTER CONTAINS NO NEW EVIDENCE WHICH WOULD WARRANT ANY CHANGE IN THE POSITION HERETOFORE TAKEN IN THE MATTER BY US, SINCE SUCH LETTER AND YOUR PREVIOUS LETTERS CONTAIN NO CLEAR OR SATISFACTORY EVIDENCE THAT THERE IS OR EVER WAS ANY LIABILITY OF THE GOVERNMENT SUCH AS YOU ALLEGE. AS STATED IN OUR SAID LETTER OF JULY 28, 1955, A SEARCH OF OUR RECORDS FAILS TO REVEAL ANY RECORD OF A CLAIM FOR $1,000 IN FAVOR OF MRS. PATSY SLUSHER, OR ANY INFORMATION THAT A CHECK IN THAT AMOUNT WAS ISSUED TO HER. IN THE ABSENCE OF CLEAR AND SATISFACTORY EVIDENCE OF THE VALIDITY AND NONPAYMENT OF A CLAIM THE ACCOUNTING OFFICERS OF THE GOVERNMENT ARE AUTHORIZED AND IT IS THEIR DUTY TO REJECT IT.

AS TO THE STATEMENT IN YOUR LATEST LETTER THAT "IF THE CHECK WAS RETURNED * * * IT WOULD HAVE BEEN RETURNED TO WASHINGTON, D.C., " YOU ARE ADVISED THAT SUCH STATEMENT APPEARS TO BE BASED UPON THE MERE SUPPOSITION THAT SUCH A CHECK WAS ISSUED. THERE IS NO RECORD THAT SUCH A CHECK WAS ISSUED OR THAT ANY LIABILITY ON THE PART OF THE GOVERNMENT EXISTS IN THE MATTER. IN REPLY TO YOUR REQUESTS FOR INFORMATION AS TO WHAT AGENCY OF THE GOVERNMENT MIGHT HAVE A RECORD OF THE ISSUANCE OF THE CHECK, YOU HAVE BEEN PREVIOUSLY ADVISED THAT THE CIVIL WAR RECORDS ON FILE IN OUR OFFICE DO NOT INDICATE SUCH A CHECK WAS ISSUED AND WE ARE NOT AWARE OF ANY OTHER GOVERNMENT AGENCY, WHICH MIGHT HAVE A RECORD OF THE ISSUANCE OF SUCH A CHECK.

ACCORDINGLY, THE ACTION HERETOFORE TAKEN IN REJECTING YOUR CLAIM WAS PROPER AND IS SUSTAINED. ANY FURTHER SIMILAR LETTER FROM YOU WOULD APPEAR TO SERVE NO USEFUL PURPOSE AND MAY BE FILED WITHOUT REPLY.
