TO ACTING CHAIRMAN, UNITED STATES CIVIL SERVICE COMMISSION:

ON JANUARY 26, 1961, THE FORMER CHAIRMAN OF THE CIVIL SERVICE COMMISSION REQUESTED OUR RECONSIDERATION OF THAT PART OF OUR DECISION OF OCTOBER 12, 1960, B-144049, 40 COMP. GEN. - , TO HIM, IN WHICH WE SAID THAT THE HEAD OF AN AGENCY CANNOT PROPERLY DISCHARGE HIS DUTY TO FIX THE WAGE RATES OF WAGE BOARD EMPLOYEES BY ISSUING A REGULATION AUTOMATICALLY ADOPTING FOR HIS EMPLOYEES THE WAGE RATES TO BE SET IN THE FUTURE BY ANOTHER AGENCY.

WE HAVE THOROUGHLY REVIEWED THAT DECISION IN THE LIGHT OF THE COMMENTS IN THE FORMER CHAIRMAN'S LETTER BUT WE CAN FIND NO REASONABLE GROUND UPON WHICH THE CONCLUSION REACHED IN THE DECISION MAY BE ALTERED.
