YOUR LETTER OF NOVEMBER 20, 1961, REQUESTS THAT WE RECONSIDER OUR DECISION OF AUGUST 30, 1961, B-046564, TO YOU, RELATING TO OUR SETTLEMENT OF MAY 24, 1961. IN THAT DECISION WE HELD THAT YOU ARE INDEBTED TO THE GOVERNMENT FOR $27.50, THE AMOUNT ALLOWED BY OUR OFFICE SETTLEMENT OF AUGUST 30, 1961, FOR AN OVERPAYMENT FOR MILEAGE AND PER DIEM IN LIEU OF SUBSISTENCE WHEN YOU RETURNED TO YOUR OFFICIAL DUTY STATION ON APRIL 14, 1960, FROM YOUR TEMPORARY DUTY STATION AT MORTON, KANSAS.

IN THAT DECISION WE SAID THAT WE HAD BEEN INFORMALLY ADVISED BY THE RURAL ELECTRIFICATION ADMINISTRATION OF THE DEPARTMENT OF AGRICULTURE THAT YOU WERE PLACED IN AN ANNUAL LEAVE STATUS FOR ONE HOUR AT THE END OF THE WORKDAY ON APRIL 14, 1960, AND FOR THREE HOURS, FROM 9 A.M., TO NOON, ON MONDAY, APRIL 18, 1960.

YOU FURNISHED WITH YOUR LETTER OF NOVEMBER 20, A COPY OF AN ADMINISTRATIVE MEMORANDUM DATED JULY 29, 1960, AUTHORIZING A CHARGE AGAINST YOUR ACCRUED ANNUAL LEAVE OF ONE HOUR AND THREE HOURS ON APRIL 14, AND 18, RESPECTIVELY. YOU ALSO FURNISHED A COPY OF A MEMORANDUM DATED FEBRUARY 2, 1961, WHICH STATES THAT "THIS MEMORANDUM SUPERCEDES OUR MEMORANDUM OF JULY 29, 1960.'

HOWEVER, THE ADMINISTRATIVE OFFICE INFORMS US BY LETTER OF DECEMBER 28, 1961, THAT YOUR LEAVE RECORD NOW SHOWS THAT YOU WERE CHARGED WITH ANNUAL LEAVE FOR ONE HOUR ON APRIL 14, AND FOR THREE HOURS ON APRIL 18, AND THE COMPUTATIONS FOR YOUR LUMP SUM LEAVE PAYMENT INCLUDED SUCH CHARGE AT THE TIME OF YOUR RETIREMENT FROM THE GOVERNMENT SERVICE ON SEPTEMBER 30, 1961. THE ADMINISTRATIVE OFFICE FURTHER INFORMS US THAT IT WAS NOT THE INTENTION OF THE MEMORANDUM OF FEBRUARY 2, 1961, TO CANCEL THESE CHARGES AGAINST YOUR ANNUAL LEAVE ACCRUAL.

THEREFORE, UPON THE PRESENT RECORD WE MUST ADHERE TO THE HOLDING IN OUR DECISION OF AUGUST 30, 1961, REGARDING YOUR INDEBTEDNESS TO THE GOVERNMENT FOR AN OVERPAYMENT OF TRAVEL EXPENSES.
