CONCERNING THE ILLEGAL PAYMENT OF PER DIEM IN LIEU OF SUBSISTENCE TO CERTAIN EMPLOYEES OF THE DEPARTMENT OF THE NAVY WHO ARE ASSIGNED TO DUTY ON THE CALIFORNIA OFFSHORE ISLANDS. THE ILLEGAL PER DIEM PAYMENTS HAVE BEEN DISCONTINUED. IN VIEW OF THE FACT THAT H.R. 11211 NOW PENDING BEFORE THE CONGRESS WOULD RELIEVE THE EMPLOYEES INVOLVED OF THEIR LIABILITY TO REFUND THE ILLEGAL PAYMENTS WE WILL NOT OBJECT IF ACTION TO COLLECT SUCH OVERPAYMENTS IS DEFERRED PENDING CONSIDERATION OF H.R. 11211 BY THE 88TH CONGRESS.

WE REFER TO THE LETTER OF MAY 19, 1964, REFERENCE NCA1411, FROM THE DEPUTY ASSISTANT COMPTROLLER, CONCERNING THE ILLEGAL PAYMENT OF PER DIEM IN LIEU OF SUBSISTENCE TO CERTAIN EMPLOYEES OF THE DEPARTMENT OF THE NAVY WHO ARE ASSIGNED TO DUTY ON THE CALIFORNIA OFFSHORE ISLANDS.

WE NOTE THAT PURSUANT TO OUR DECISION OF MAY 4, 1964, B-153571, TO YOU, THE ILLEGAL PER DIEM PAYMENTS HAVE BEEN DISCONTINUED.

IN VIEW OF THE FACT THAT H.R. 11211 NOW PENDING BEFORE THE CONGRESS WOULD RELIEVE THE EMPLOYEES INVOLVED OF THEIR LIABILITY TO REFUND THE ILLEGAL PAYMENTS WE WILL NOT OBJECT IF ACTION TO COLLECT SUCH OVERPAYMENTS IS DEFERRED PENDING CONSIDERATION OF H.R. 11211 BY THE 88TH CONGRESS.
