A firm protested the Environmental Protection Agency's (EPA) rejection of its bid for information management services, contending that EPA improperly determined that its bid did not constitute an "offer" as defined by federal procurement regulations because it was submitted prior to the solicitation's issuance. GAO held that the protester's bid, was a valid offer in response to EPA's solicitation. Accordingly, the protest was sustained, and GAO recommended that EPA: (1) reevaluate the proposals in accordance with the solicitation's evaluation criteria; and (2) reimburse the protester for its protest costs.
