[Protest of VA Contract Award for Home Oxygen Services]
B-283295.2: Nov 8, 1999
- Full Report:
A firm protested a Department of Veterans Affairs (VA) contract award for home oxygen services, contending that VA: (1) improperly evaluated its proposal under the past performance and demonstrated capability factor; (2) failed to contact its past performance references; and (3) improperly considered certain negative performance information submitted with its proposal. GAO held that: (1) VA reasonably determined that the awardee's proposed staffing and facilities was better than the protester's; (2) VA was not required to contact the protester's past performance references; and (3) VA had no obligation to disregard the negative performance information, nor was VA required to contact the accrediting organization to investigate the information. Accordingly, the protest was denied.
