A firm protested the Ballistic Missile Defense Organization's (BMDO) determination not to award it phase II funding for a project proposed under the Department of Defense Small Business Innovation Research program, contending that BMDO improperly evaluated its proposal. GAO held that BMDO unreasonably evaluated the protester's proposal and funding would have been granted had BMDO evaluated the proposal in a manner consistent with the evaluation criteria set forth in the solicitation. Accordingly, the protest was sustained, and GAO recommended that BMDO: (1) reevaluate the protester's proposal in accordance with the solicitation's evaluation criteria, and reconsider whether the protester's proposal should be funded; and (2) reimburse the protester for its bid protest costs.
