A firm protested an Army sole-source foreign military sales (FMS) procurement for vehicle spare parts, contending that the sole-source procurement was improper because the Army was funding the procurement using military assistance funds rather than the Philippine government's FMS funds. GAO held that the sole-source procurement was permissible, since the Foreign Assistance Act permitted the transfer of military assistance funds to a foreign government's FMS account. Accordingly, the protest was denied.
