A firm protested the Army's rejection of its bid for lightweight howitzer development, contending that the Army improperly eliminated it from competition for subcontracting with a Department of Defense (DOD) activity. GAO held that the Army could not accept the protester's bid, since the: (1) bid was based on an unauthorized subcontract with an Army industrial facility; (2) subcontracting facility supplied the actual prototype howitzer and support team personnel; and (3) solicitation was not open to participation by DOD activities. Accordingly, the protest was denied.
