A firm protested the Army Corps of Engineers' rejection of its bid for the lease of a dredge and related equipment, contending that: (1) its bid bond conformed with the solicitation requirements; and (2) the Corps should have confirmed the bond's validity if it was concerned about the altered numbers on the bond and the power of attorney. GAO held that the Corps properly determined that the protester's bid was nonresponsive, since: (1) there was no evidence that the surety consented to the alterations in the bond's liability limit; and (2) the bond was materially defective as submitted and could not be cured after bid opening. Accordingly, the protest was denied.
