The Federal Aviation Administration requested a decision concerning an employee's claim for real estate purchase expenses incident to his transfer to a new duty station. GAO held that: (1) the employee could be reimbursed for certain expenses related to the purchase of a lot near his new duty station, since the employee settled before expiration of the 3-year time limit; (2) the employee could not be reimbursed for expenses related to the construction of his new residence, since settlement occurred after the 3-year time limit; and (3) even though the settlement delays were due to circumstances beyond the claimant's control, the time limit could not be waived. Accordingly, the claim was allowed in part and denied in part.
