A confined Navy officer claimed entitlement to a variable housing allowance, contending that applicable law and Navy regulations established his entitlement, since he was required to live at a different location from his dependents. GAO held that the claimant was not entitled to the allowance, since he was not separated from his dependents because of military necessity, but because of his conviction. Accordingly, the claim was denied.
