A firm protested a proposed Navy contract award for mess deck improvements, contending that the Navy improperly: (1) based the solicitation's specifications on its proprietary information; and (2) excluded it from the competition when it failed to solicit its bid under small purchase procedures. GAO held that the: (1) protester failed to show any evidence that the Navy derived the solicitation's specifications from its proprietary data; and (2) Navy did not improperly exclude protester from the competition. Accordingly, the protest was denied.
