The U.S. Secret Service requested an opinion regarding the limitations to Secret Service members' maximum biweekly premium pay and aggregate annual compensation. GAO held that: (1) Secret Service members' biweekly and aggregate compensation is subject to two independent limitations; (2) the first limitation is that each member's adjusted basic and longevity pay may not exceed the basic pay rate for level V of the Executive Schedule; and (3) the second limitation is that each member's aggregate pay rate for adjusted basic and premium pay for any period may not exceed the minimum scheduled basic pay rate of the District of Columbia Police and Fire Chief. Accordingly, the Secret Service should make adjustments to pay that are not time-barred, even for members who did not file underpayment claims.
