A firm protested an Army contract award for binoculars, contending that the awardee's bid price was materially unbalanced and the Army improperly: (1) waived a mandatory technical requirement for the awardee; (2) downgraded its bid based on unstated evaluation criteria; and (3) ignored a negative preaward survey in evaluating the awardee's bid. GAO held that the: (1) awardee's bid price reasonably reflected the cost of an engineering modification required for initial prototypes; (2) awardee sufficiently documented its intent to comply with the mandatory technical requirements; (3) Army properly evaluated the protester's bid in accordance with stated evaluation criteria; and (4) Army properly considered the preaward survey in evaluating the awardee's bid. Accordingly, the protest was denied.
