A firm protested the National Aeronautics and Space Administration's (NASA) rejection of its bid for construction, contending that NASA improperly rejected its bid as nonresponsive, since the rider it placed on its bid bond did not affect its responsiveness. GAO held that NASA properly rejected the protester's bid as nonresponsive, since the protester's bid bond could only be enforced upon the acceptance of an unacceptable performance bond. Accordingly, the protest was denied.
