A firm protested a Bureau of Land Management (BLM) lease award for office/warehouse space, wareyard, and parking space, contending that the awardee failed to provide the required zoning certificate. GAO held that BLM should have rejected the awardee as nonresponsible and referred the matter to the Small Business Administration, since the: (1) solicitation's zoning certificate requirement was a definitive responsibility criterion and a precondition for award; and (2) awardee failed to submit the required certificate or evidence of equivalent compliance. Accordingly, the protest was sustained and GAO recommended that BLM: (1) not terminate the awardee's lease award for convenience; and (2) reimburse the protester for its bid preparation and protest costs.
