A firm protested a U.S. Patent and Trademark Office (PTO) subcontract award for a biotechnology computer system. GAO held that it would not consider the protest, since the: (1) procurement was not requested by a federal agency; and (2) prime contractor had substantial responsibility for conducting the procurement and evaluating the technical proposals. Accordingly, the protest was dismissed.
