The Bureau of Alcohol, Tobacco, and Firearms (BATF) requested an advance decision on an employee's claim for merit pay, a bonus, and attorney fees pursuant to his grievance regarding his performance rating and subsequent reevaluation. GAO held that: (1) BATF did not cancel and void the employee's original performance rating; (2) the employee's new rating did not void his old rating, since they concerned different time periods; (3) the employee was not entitled to the merit pay or bonus, since his original performance rating did not qualify him for those rewards; and (4) the employee was not entitled to reimbursement for attorney fees, since he did not prevail in his grievance. Accordingly, the claim was denied.
