A firm protested an Advanced Research Project Agency (ARPA) contract award for the development of vapor phase manufacturing technology, contending that ARPA: (1) improperly evaluated the technical and cost proposals; (2) failed to conduct discussions with bidders regarding bid deficiencies; and (3) should have awarded a procurement contract. GAO held that: (1) there was no evidence that a procurement contract was required; and (2) ARPA properly used a multi-party partnership agreement to support its research and development project. Accordingly, the protest was denied.
