A firm protested a Department of Health and Human Services (HHS) contract award for maintaining a mouse breeding facility, contended that HHS: (1) used an undisclosed evaluation criterion to evaluate the technical proposals; and (2) failed to hold meaningful discussions. GAO held that HHS: (1) reasonably considered the disputed evaluation factor under a broader, related evaluation criterion; (2) held meaningful discussions with the protester regarding its bid deficiencies; and (3) was not required to discuss the remaining bid deficiencies contained in the protester's second best-and-final offer. Accordingly, the protest was denied.
