A firm protested the National Oceanic and Atmospheric Administration's (NOAA) rejection of its bid for the design, repair, and modernization of a research vessel, contending that NOAA: (1) improperly eliminated its bid from the competitive range, since its bid could have been made acceptable during discussions; and (2) failed to timely notify it that its bid was technically unacceptable. GAO held that: (1) NOAA reasonably determined that the protester's technical proposal was unacceptable, since the protester failed to provide required information; (2) NOAA properly eliminated the protester's bid from the competitive range, since it required substantial revisions to be made technically acceptable; and (3) the protester had no basis to question the award decision. Accordingly, the protest was denied.
