Two firms protested a Federal Aviation Administration (FAA) solicitation for engine generator sets, contending that the solicitation's delivery schedule and benchmark testing requirements were unduly restrictive. GAO held that: (1) evidence showed that the items being delivered were critical in nature, and the required delivery schedule was necessary for FAA to meet its needs; and (2) the benchmark testing requirement was reasonably related to FAA minimum needs. One firm also contended that the solicitation's lack of a progress payment provision unduly restricted competition. GAO held that: (1) FAA addressed the protester's allegation in the agency report; and (2) the protest was academic, since the protester did not file comments in response to the report. Accordingly, one protest was denied and one protest was dismissed.
