A Navy employee requested waiver of his indebtedness for erroneous overseas post allowances, contending that: (1) the State Department notice did not constitute official notice and contradicted advice he received from the Navy; and (2) he did not receive formal, written notice from the Navy until 4 months later. GAO held that the employee was: (1) on notice that his entitlement was questionable and should have set aside the erroneous payments for possible refund until the matter was resolved; and (2) not entitled to waiver of indebtedness. Accordingly, waiver was denied.
