[Protest of BOP Solicitation for Vending Beverage Services]

A firm protested a Bureau of Prisons (BOP) solicitation for vending beverage services, contending that BOP misclassified the solicitation and prevented it from submitting a bid. GAO held that: (1) the solicitation classification was inconsistent with the procurement; and (2) in misclassifying the solicitation, BOP did not encourage full and open competition. Accordingly, the protest was sustained and GAO recommended that BOP: (1) cancel the solicitation and reissue it under the appropriate classification; and (2) reimburse the protester for its protest costs.
