A firm protested the Army Corps of Engineers' rejection of its bid for bleacher repair, contending that the Corps improperly rejected its bid as nonresponsive, since its bid bond was not defective. GAO held that the protester provided sufficient documentation that the power-of-attorney was valid and the signer of the bid bond had the authority to bind the surety. Accordingly, the protest was sustained and GAO recommended that the Corps: (1) terminate the awardee's contract and make award to the protester, if appropriate; and (2) reimburse the protester for its protest costs.
