A firm protested the General Services Administration's (GSA) exclusion of its bid for investigation of discrimination complaints and preparation of equal employment opportunity (EEO) investigative reports, contending that: (1) GSA unreasonably evaluated its technical proposal; and (2) the solicitation unfairly required submission of a sample EEO investigative report based on an actual case when a waiver to use original EEO documentation could not be obtained. GAO held that: (1) GSA reasonably evaluated the protester's technical proposal and excluded it from the competitive range, since it contained numerous deficiencies; and (2) the protester untimely filed after bid opening its protest of alleged solicitation improprieties. Accordingly, the protest was denied in part and dismissed in part.
