Sec. 1552 and the Correction Board has denied the relief sought, such action is not subject to review by the General Accounting Office.

 

Dear Mr.          :

This is in regard to your appeal of our Claims Group's action concerning your request for our Office's assistance in correcting your military records. You wish to have your records corrected as a result of what you contend were illegally constituted promotion boards convened in 1968 and 1969, which did not recommend you for promotion.

As the Claims Group advised you, except when procured by fraud, the action of a Board for Correction of Military Records is conclusive on all officers of the United States. 10 U.S.C. Sec. 1552(a). When a Board declines to correct a record, we have no jurisdiction to entertain the matter. 55 Comp.Gen. 961 (1976).

Therefore, our Office cannot be of assistance to you.
