A firm requested reconsideration of its dismissed protest of a United States Geological Survey (USGS) solicitation for a plasma-mass spectrometer. GAO had held that the protester did not timely comment on the USGS protest report. In its request for reconsideration, the protester contended that it did not receive GAO acknowledgement of the agency report and did not know that its comments were due to GAO within 10 days. GAO held that the protester had actual and constructive knowledge of the comment period requirement, since it had recently filed a separate protest and GAO had informed it of the requirement at that time. Accordingly, the original decision was affirmed.
