A Coast Guard certifying officer requested an advance decision regarding whether it should offset an employee's claim to back pay and allowances for the period during his civilian employment. GAO held that the: (1) Coast Guard's payment of back pay and allowances should not be offset by civilian wages earned during the period after separation, since those wages were from off-duty, full-time employment the member performed while on military duty; and (2) claimant was entitled to his back pay and allowances. Accordingly, the claimant was entitled to payment without offset.
