A firm protested a National Guard Bureau (NGB) solicitation for construction services, contending that NGB: (1) should have set aside the solicitation for small disadvantaged businesses; and (2) failed to properly investigate whether there were small businesses interested in competing. GAO held that NGB: (1) did not properly investigate whether there was sufficient small business interest; and (2) should have set aside the procurement, since two small businesses expressed interest in competing for award and NGB had set aside the predecessor contract. Accordingly, the protest was sustained, and GAO recommended that NGB: (1) cancel the solicitation and set aside the resolicitation; and (2) reimburse the protester for its protest costs.
