A firm protested the Army's rejection of its bid for enhanced manpack ultrahigh frequency terminals, contending that the Army: (1) improperly excluded its bid from the competitive range, since it was susceptible of being made technically acceptable through discussions; (2) did not treat the bidders equally; and (3) failed to follow the solicitation's evaluation criteria. GAO held that the: (1) Army reasonably evaluated the protester's bid and determined that it could not be made acceptable through discussions, since it contained numerous and substantial deficiencies; (2) protester did not present any evidence that the Army treated the bidders unequally; (3) Army evaluated the bids in accordance with the solicitation's evaluation criteria; and (4) Army reasonably excluded the protester's bid from the competitive range. Accordingly, the protest was denied.
